1. Introduction
These Terms of Service govern your access to and use of:
Website: ledskintherapymachine.com
Store: LED Skin Therapy Machine
They also apply to orders placed through our website and any related services, features, content or communications that we provide.
Throughout these Terms:
- “we”, “us” and “our” refer to the legal operator of LED Skin Therapy Machine;
- “you” and “your” refer to the person accessing our website or purchasing from us;
- “Website” refers to ledskintherapymachine.com;
- “Product” refers to the LED Skin Therapy Machine with Hydrating Nano Spray and any accessories or other goods sold by us;
- “Services” refers to the Website, online store, customer support and related services.
By using the Website or placing an order, you agree to these Terms.
If you do not agree to these Terms, you should not use the Website or place an order.
Nothing in these Terms limits or excludes any rights that cannot lawfully be limited or excluded under applicable consumer law.
2. Who we are
LED Skin Therapy Machine is operated by:
Trading name: LED Skin Therapy Machine
Email: skintherapymachinesupport@gmail.com
Website: ledskintherapymachine.com
For questions about these Terms, orders or our Website, contact us using the details above.
3. Other policies
These Terms should be read together with our:
- Privacy Policy;
- Return and Refund Policy;
- Shipping Policy;
- Cookie Preferences;
- any product-specific instructions, warnings or notices displayed on the Website or supplied with the Product.
Those policies form part of the agreement between you and us where relevant.
If there is an inconsistency:
- the Return and Refund Policy will apply to returns, cancellations and refunds;
- the Shipping Policy will apply to processing, delivery, tracking and customs;
- the Privacy Policy will apply to personal information;
- these Terms will apply to all other matters.
Nothing in another policy overrides your mandatory consumer rights.
4. Eligibility to place an order
You must be at least 18 years old and legally capable of entering into a contract to place an order.
Where a person under 18 wishes to purchase a Product, the order must be placed by a parent or legal guardian.
By placing an order, you confirm that:
- the information you provide is complete and accurate;
- you are authorised to use the selected payment method;
- you are purchasing for lawful purposes;
- you will follow the Product instructions and safety information;
- you are not using the Website fraudulently or on behalf of an unauthorised third party.
We may take reasonable steps to verify your identity, payment information or order details.
5. Personal and domestic use
Unless a product listing expressly states otherwise, our Products are supplied for personal and domestic use.
You must contact us before placing an order for:
- commercial resale;
- professional treatment services;
- bulk purchasing;
- distribution;
- use within a clinic, salon or other commercial setting.
We may refuse or cancel orders that we reasonably believe are intended for unauthorised resale, commercial distribution or fraudulent activity.
This section does not affect consumers purchasing a Product for ordinary personal use.
6. Website information
We take reasonable care to ensure that information displayed on the Website is clear and accurate.
However, Website content may occasionally contain:
- typographical errors;
- technical inaccuracies;
- outdated information;
- incorrect availability;
- pricing errors;
- minor differences in colours or appearance caused by screens, lighting or photography.
Product images are intended to represent the Product as accurately as reasonably possible. The appearance of colours, reflections, lighting and surface finishes may vary depending on the screen or device used.
Packaging, manuals or minor non-material design details may occasionally be updated by the manufacturer or supplier.
We will not make a material substitution or material change to the Product ordered without informing you and obtaining any consent required by law.
7. Product descriptions and specifications
Each Product is supplied according to the description and specifications shown on the relevant product page at the time the order is placed.
You should review the Product page carefully before ordering, including:
- dimensions;
- functions;
- contents of the package;
- power requirements;
- instructions;
- warnings;
- recommended usage;
- delivery information;
- price.
The Product supplied must be of satisfactory quality, fit for any purpose made known to us where the law requires, and match its description. These statutory standards cannot be removed by these Terms.
8. Product availability
All orders are subject to Product availability.
Adding a Product to your cart does not reserve it.
If a Product becomes unavailable after you place an order, we may:
- contact you with an updated availability date;
- offer an appropriate alternative, which you are free to decline;
- cancel the affected order and issue a full refund.
We will not supply a materially different substitute without your agreement.
9. Product use and safety
You must read and follow all instructions, warnings and safety information supplied with the Product.
You must:
- use the Product only for its intended purpose;
- follow the recommended treatment time and usage instructions;
- use any protective equipment supplied or required;
- use only a suitable power supply and accessories;
- keep the Product away from water unless the instructions expressly state otherwise;
- stop using the Product if it appears damaged, overheats, produces an unusual smell or operates abnormally;
- keep the Product out of reach of children when not being supervised;
- avoid modifying, dismantling or attempting unauthorised repairs.
Do not use the Product where the instructions, warnings or advice from a suitably qualified healthcare professional indicate that it would be unsuitable for you.
You should seek appropriate professional advice before use where you:
- have a medical condition that could affect safe use;
- are receiving treatment that could interact with light exposure;
- have concerns about photosensitivity, your eyes or your skin;
- are unsure whether the Product is suitable for you.
The warnings supplied with the Product take priority over general Website information.
We are responsible for taking reasonable steps to ensure Products supplied by us comply with applicable product-safety and labelling requirements. Businesses that manufacture, import, distribute or sell consumer products in the UK remain responsible for ensuring that those products are safe.
10. General skincare information
Information provided on the Website, social-media pages, advertising, product materials or customer-support communications is provided for general informational purposes.
It is not:
- medical advice;
- a medical diagnosis;
- a prescription;
- a substitute for advice from a doctor, dermatologist, pharmacist or other qualified professional;
- a guarantee that a particular skin concern will improve.
The Product is not intended to diagnose, treat or cure a medical condition unless a specific legally authorised claim expressly states otherwise.
You should not delay seeking professional medical advice because of information found on our Website.
11. Results and individual differences
Individual experiences and cosmetic results can vary.
Results may depend on factors including:
- frequency and consistency of use;
- correct use;
- skin characteristics;
- lifestyle;
- other products used;
- individual response;
- the concern being targeted.
We do not guarantee:
- a particular cosmetic result;
- results within a particular number of days;
- that every customer will experience the same outcome;
- that the Product will replace professional treatment;
- permanent results.
Before-and-after images, reviews and customer experiences illustrate individual experiences only unless expressly stated otherwise.
Nothing in this section allows us to misrepresent the Product or removes your rights where it is faulty, unsafe, not as described or otherwise fails to comply with applicable law.
12. How to place an order
You can place an order by:
- Selecting the Product and available options.
- Adding the Product to your cart.
- Reviewing your order.
- Providing delivery and contact information.
- Selecting an available payment method.
- Reviewing the price, delivery information and relevant policies.
- Submitting the order through checkout.
You are responsible for checking your order carefully before submitting it.
Please contact us promptly if you notice an error after ordering. We will make reasonable efforts to correct it, but changes may not be possible once fulfilment has begun.
13. Order acknowledgement and contract formation
After submitting an order, you should receive an automated order-confirmation email.
That email confirms that we have received your order. It does not necessarily confirm that we have accepted it.
A contract between you and us is formed when we send an email confirming that:
- the order has been accepted; or
- the Product has been dispatched,
whichever occurs first.
Where our checkout process or confirmation email expressly states that acceptance occurs at a different stage, that clearly stated process will apply.
If we cannot accept your order, we will inform you and refund any payment collected.
14. Reasons we may refuse or cancel an order
We may refuse or cancel an order where reasonably necessary because:
- the Product is unavailable;
- payment cannot be authorised;
- the delivery address is incomplete or invalid;
- the carrier cannot deliver to the destination;
- the order breaches import or export restrictions;
- we reasonably suspect fraud or unauthorised payment;
- an obvious price or product error has occurred;
- the quantity ordered suggests unauthorised resale;
- fulfilling the order would be unlawful;
- the customer has materially breached previous agreements with us;
- the order presents a genuine security or safety concern.
Where we cancel an accepted order, we will refund the amount paid for the cancelled Product unless the law allows another remedy.
We will not cancel an order for an arbitrary or discriminatory reason.
15. Prices
The price payable is the price displayed at checkout when the order is submitted.
Prices may be changed at any time, but changes will not normally affect an order that has already been accepted.
The Website will indicate:
- the product price;
- available discounts;
- delivery charges, if any;
- taxes collected at checkout;
- the total amount payable.
Where taxes are required to be included in the displayed price, they will be included.
International customers may also be responsible for customs duties, import taxes, brokerage charges or local handling fees, as explained in our Shipping Policy.
16. Pricing and listing errors
Despite reasonable care, a Product may occasionally be displayed with an obvious pricing, discount or description error.
If we identify an obvious error before accepting the order, we may:
- contact you and offer the opportunity to purchase at the correct price;
- cancel the order and issue a full refund.
We will not charge a higher price without your agreement.
If the error was not obvious and the order has already been accepted, your rights will depend on the circumstances and applicable law.
17. Payments
Available payment methods are displayed at checkout.
Payments may be processed by Shopify Payments, PayPal or another payment provider shown during checkout.
By providing payment information, you confirm that:
- the information is accurate;
- you are authorised to use the payment method;
- sufficient funds or credit are available;
- the payment does not breach any law.
Payment providers may carry out:
- authorisation checks;
- identity verification;
- fraud screening;
- currency conversion;
- security checks.
Their services may also be governed by their own terms and privacy notices.
We do not ordinarily receive or store your full payment-card number or card security code.
18. Payment failures and chargebacks
If payment is declined, reversed or cannot be verified, we may suspend or cancel the order.
Please contact us before starting a chargeback where possible so that we have an opportunity to investigate and resolve the issue.
Starting a chargeback does not:
- create additional return rights;
- remove the requirement to return a Product where a return is required;
- prevent us from providing relevant order, delivery and communication evidence to the payment provider.
Nothing in this section prevents you from exercising a lawful right through your bank, card issuer or payment provider.
19. Promotions and discount codes
Promotions and discount codes may be subject to additional conditions displayed at the time of the offer.
Unless otherwise stated:
- offers cannot be exchanged for cash;
- only one discount code may be used per order;
- codes must be used before expiry;
- codes cannot normally be applied after an order has been placed;
- promotions apply only to eligible Products;
- offers are subject to availability;
- discounts cannot be used fraudulently or transferred for resale.
We may withdraw or correct a promotion where:
- an obvious error has occurred;
- the promotion is being misused;
- fraud is suspected;
- continuing the promotion would be unlawful.
We will not remove a discount from an already accepted order without a lawful reason.
Sale and promotional Products retain all applicable statutory rights.
20. Gift items and complimentary products
Where a complimentary item is supplied as part of a promotion, the promotional conditions will be stated clearly.
If the qualifying order is cancelled or returned in full, the complimentary item may also need to be returned.
Where this requirement was clearly disclosed, we may make a reasonable deduction for a complimentary item that is not returned, but only where permitted by law.
This section does not affect rights relating to faulty, unsafe or misdescribed goods.
21. Shipping and delivery
Processing, tracking, delivery, customs and lost-parcel arrangements are explained in our Shipping Policy.
We currently offer:
Free tracked worldwide shipping
Orders are normally processed within:
3–5 business days
Processing time is separate from delivery time.
The delivery estimate applicable to your destination should be displayed during checkout.
Unless a different delivery period has been agreed, UK online orders must generally be delivered without undue delay and within 30 days.
22. Delivery address
You are responsible for providing a complete and accurate delivery address.
Please contact us immediately if you notice an error.
We will make reasonable efforts to amend the address, but we cannot guarantee changes after processing or dispatch has begun.
Where a parcel is returned solely because you supplied an inaccurate or incomplete address, we may require payment of reasonable, evidenced reshipping costs where permitted by law.
This does not apply where the delivery problem was caused by us, our fulfilment provider or the carrier.
23. Transfer of risk and ownership
Where we select the carrier, the Product remains at our risk until it enters:
- your physical possession; or
- the physical possession of a person you identified to receive it.
Ownership of the Product passes to you when:
- full payment has been received; and
- the Product has been delivered,
unless applicable law requires otherwise.
Different risk rules may apply where you independently arrange a carrier that was not offered by us.
24. Customs and international orders
International orders may be subject to:
- import taxes;
- customs duties;
- brokerage charges;
- carrier administration fees;
- local clearance charges.
Unless checkout expressly states that these costs are included, they are not included in the Product price or free-shipping offer and are the customer’s responsibility.
Further details are provided in our Shipping Policy.
Customers outside the United Kingdom may have mandatory rights under the laws of the country where they live. Nothing in these Terms removes rights that cannot legally be excluded.
25. Cancellations, returns and refunds
Cancellation, return and refund rights are explained in our Return and Refund Policy.
For eligible change-of-mind online purchases, UK customers generally have 14 days after delivery to notify the retailer that they wish to cancel, followed by a further 14 days to return the goods.
You should contact:
skintherapymachinesupport@gmail.com
before sending a Product back.
Returns must be sent to the return address provided by us. Do not automatically return a Product to the address shown on the original shipping label.
Nothing in our Return and Refund Policy removes rights relating to faulty, unsafe or misdescribed goods.
26. Faulty, damaged or misdescribed Products
Products must comply with applicable consumer law.
Contact us promptly where a Product:
- arrives damaged;
- is faulty;
- is unsafe;
- is not as described;
- is not fit for an applicable purpose;
- is missing included components;
- is materially different from the Product ordered.
We may request reasonable evidence such as:
- photographs;
- video;
- the order number;
- packaging images;
- the shipping label;
- a description of the problem.
This information helps us investigate the issue but does not remove your legal rights.
Depending on the circumstances and applicable law, you may be entitled to:
- rejection and refund;
- repair;
- replacement;
- price reduction;
- another appropriate remedy.
27. Damage caused after delivery
We are not responsible for a fault or damage caused solely by:
- accidental damage after delivery;
- misuse;
- failure to follow instructions;
- unsuitable storage;
- improper cleaning or maintenance;
- use with an incompatible power supply;
- unauthorised modifications;
- unauthorised repairs;
- ordinary wear and tear;
- use outside the Product’s intended purpose.
This does not apply where the Product was already faulty, unsafe, damaged or non-compliant when supplied.
28. Customer accounts
Where customer accounts are available, you are responsible for:
- providing accurate account information;
- keeping login credentials confidential;
- restricting access to your account;
- notifying us promptly of suspected unauthorised access.
You must not:
- impersonate another person;
- create an account using false information;
- access another customer’s account;
- use automated systems to create accounts;
- use an account for fraud or unlawful activity.
We may suspend an account where reasonably necessary to protect customers, investigate fraud or prevent misuse.
We will not remove access to an account in a way that unlawfully affects an existing order or consumer right.
29. Reviews, comments and other submissions
You may be able to submit reviews, photographs, feedback, questions or other content.
You confirm that content submitted by you:
- is based on your genuine experience;
- is accurate to the best of your knowledge;
- does not impersonate another person;
- does not contain unlawful, threatening, defamatory or discriminatory material;
- does not infringe intellectual-property or privacy rights;
- does not contain malware, spam or unauthorised advertising;
- does not disclose another person’s private information without permission.
You retain ownership of your content.
By voluntarily submitting content for publication, you grant us a non-exclusive, worldwide, royalty-free licence to:
- display it;
- reproduce it;
- format it;
- resize it;
- distribute it through our Website and brand channels;
- use it to promote the Product or business.
This licence applies only to the extent reasonably necessary for those purposes.
We may moderate or remove content that breaches these Terms, is unlawful, contains personal information, is irrelevant or is reasonably suspected to be fraudulent.
We will not publish a private customer-support message as a public review without permission.
We will not knowingly alter a genuine review in a way that materially changes its meaning.
30. Intellectual property
Unless otherwise stated, the Website and its contents are owned by or licensed to us.
This includes:
- branding;
- logos;
- photographs;
- videos;
- graphics;
- product copy;
- page layouts;
- downloadable materials;
- website design;
- written content.
You may use the Website for personal and lawful shopping purposes.
You must not, without permission:
- reproduce substantial Website content;
- copy our branding;
- republish photographs or videos;
- scrape Website data;
- create misleading copies of our Website;
- use our content to impersonate us;
- remove copyright or ownership notices;
- use our content for commercial resale.
Nothing in these Terms transfers ownership of our intellectual property to you.
31. Third-party intellectual property
Third-party names, logos, payment marks and platform branding belong to their respective owners.
References to third-party platforms do not imply sponsorship or endorsement unless expressly stated.
You must contact us if you believe content on our Website infringes your rights.
32. Third-party services
Our Website may rely on third-party providers, including:
- Shopify;
- payment providers;
- delivery carriers;
- fulfilment providers;
- analytics services;
- review platforms;
- advertising platforms;
- customer-support tools.
Some third-party services are governed by their own terms and privacy notices.
We are not responsible for the independent operation of a third-party website that you choose to visit.
However, using third-party providers does not remove responsibilities that we owe to you as the retailer.
33. Third-party links
The Website may contain links to third-party websites or social-media platforms.
We do not control those websites and are not responsible for:
- their content;
- privacy practices;
- security;
- availability;
- goods or services supplied independently by them.
You should review the applicable terms and privacy information before using a third-party website.
This section does not apply where the third party is acting on our behalf in fulfilling our obligations to you.
34. Privacy and cookies
We process personal information as explained in our Privacy Policy.
We use cookies and similar technologies for purposes including:
- essential Website functions;
- security;
- checkout;
- remembering preferences;
- analytics;
- advertising, where permitted.
You can review or update non-essential cookie choices through Cookie Preferences on the Website.
35. Prohibited use
You must not use the Website:
- for an unlawful or fraudulent purpose;
- to infringe another person’s rights;
- to submit false payment or contact information;
- to transmit malware or harmful code;
- to interfere with Website security;
- to scrape or copy content without permission;
- to attempt unauthorised access;
- to harass or threaten another person;
- to place fraudulent orders;
- to manipulate reviews or promotions;
- to misrepresent your identity;
- to resell Products without authorisation;
- in a way that damages the Website or prevents others from using it.
We may restrict access where reasonably necessary to prevent or investigate prohibited activity.
36. Website availability
We aim to keep the Website reasonably available and secure.
We do not guarantee that it will always be:
- uninterrupted;
- completely error-free;
- compatible with every device;
- free from all technical problems;
- available during maintenance or events outside our control.
We may temporarily suspend access for:
- maintenance;
- security updates;
- technical repairs;
- legal compliance;
- circumstances outside our reasonable control.
This section does not affect any order already accepted or any right you have under consumer law.
37. Our liability to consumers
We are responsible for losses that are a foreseeable result of:
- our breach of these Terms; or
- our failure to use reasonable care and skill.
A loss is foreseeable where it was obvious that it might happen or where both you and we knew it might happen when the contract was formed.
We are not responsible, to the extent permitted by law, for loss caused solely by:
- your misuse of the Product;
- your failure to follow instructions or warnings;
- unauthorised modifications or repairs;
- inaccurate information supplied by you;
- third-party services that you independently selected;
- circumstances outside our reasonable control where we took reasonable steps to reduce the effect.
Where you purchase as a consumer, we do not accept liability for business losses such as:
- lost profits;
- lost revenue;
- loss of business opportunity;
- business interruption.
This is because the Products are normally supplied for personal and domestic use.
38. Liability that is not excluded
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- breach of mandatory consumer rights;
- defective products where liability cannot lawfully be excluded;
- any other matter for which liability cannot legally be excluded or limited.
Any limitation in these Terms applies only to the maximum extent permitted by law.
39. Circumstances outside our reasonable control
We are not responsible for delay caused by an event we could not reasonably prevent, including:
- severe weather;
- natural disasters;
- war or civil unrest;
- industrial action;
- customs disruption;
- carrier emergencies;
- government restrictions;
- major network or system failures;
- public-health emergencies.
Where such an event affects an order, we will take reasonable steps to:
- inform you;
- reduce the effect;
- resume performance;
- provide any remedy required by law.
If the delay becomes substantial, you may have cancellation rights under applicable law.
40. Complaints
Please contact us where you have a complaint about:
- an order;
- delivery;
- the Product;
- customer service;
- a refund;
- the Website.
Contact:
skintherapymachinesupport@gmail.com
Please include:
- your name;
- order number, where applicable;
- a clear explanation of the issue;
- relevant dates;
- supporting photographs or documents;
- the outcome you are seeking.
We will investigate and respond within a reasonable period.
Privacy-related complaints will be handled in accordance with our Privacy Policy.
41. Changes to these Terms
We may update these Terms to reflect:
- changes to our business;
- new Website features;
- changes to Products or services;
- changes to our providers;
- legal or regulatory requirements;
- security or operational improvements.
The updated version will be published on the Website with a revised “Last updated” date.
Changes will apply prospectively.
The Terms in force when an order is accepted will normally continue to govern that order unless:
- a change is legally required;
- you agree to the change;
- the change is more favourable to you.
42. Assignment
We may transfer our rights or obligations under these Terms as part of:
- a business sale;
- merger;
- restructuring;
- transfer to an affiliated company.
Any transfer will not reduce your rights.
You may transfer your rights where the law permits or with our written agreement.
43. No waiver
If we do not immediately enforce a right under these Terms, that does not mean that we have waived it.
A delay in taking action does not prevent us from taking action later, subject to applicable limitation periods and law.
44. Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed or limited to the minimum extent necessary.
The remaining provisions will continue to apply.
45. Entire agreement
These Terms, together with the policies and information incorporated into them, form the agreement between you and us concerning your use of the Website and purchase of Products.
This section does not exclude:
- statements that form part of the contract under consumer law;
- liability for misrepresentation;
- information that we are legally required to provide;
- rights that cannot legally be excluded.
46. Governing law and courts
These Terms and contracts between you and us are governed by the laws of England and Wales.
If you live in England or Wales, proceedings may be brought in the courts of England and Wales.
If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom where you live.
If you live outside the United Kingdom, you may have the benefit of mandatory consumer laws and local court rights that cannot lawfully be excluded by these Terms.
Nothing in this section removes mandatory protections available in the country where you ordinarily live.
